TERMS AND CONDITIONS
PLEASE read these ‘Terms & Conditions’ (T&C) for stays at 7 Donlan Road to fully understand
ALL the house rules and your responsibilities prior to and during your stay, and also on departure.
They are available in the Property’s ‘Compendium’ or at www.7donlanroad.com.au.
1. DEFINITIONS
“Booking” means the period for which you have paid to stay at the Property.
“Property” means 7 Donlan Road, Mollymook Beach and all its fixtures, fittings, contents and equipment.
“Management” means the owners and managers of the Property and any third parties authorised by the owner.
"Guests" means the people who stay overnight in the Property during the Booking and who are listed on the Booking Form.
"Visitor" means a person a Guest permits to visit the Property during the Booking.
“Overnight Stay” is anytime after 11pm and outside guests in the property after this time will be charged as a guest.
“Party” means 12 people or more at the Property.
2.ACCEPTANCE & RESPONSIBILITY
Payment of the Booking Deposit constitutes acceptance of these Terms and Conditions.
3. CHECK IN/ OUT
(a) Check-in time is not before 3pm on arrival date and check-out time is 10am on the departure date.
(b) Early arrival and late departure is subject to prior arrangement and availability and extra charges may apply.
(c) You must notify us of your expected arrival time on the booking form.
(d) Check-in/check-out and key collection/return procedure will be advised prior to arrival.
4. PAYMENT
(a) A 50% deposit, completed booking form and copy of your drivers licence must be received within 7 days after the booking is taken.
(b) Bookings are not confirmed unless and until this deposit is received.
(c) Payment in full must be received no later than 2 weeks prior to your arrival.
(d) Payments of the amount due must be received in Australian dollars net of any bank or other transaction charges.
(e) Please ensure payments are made within the specified time limits or the booking will be cancelled without notice or liability to you.
(f) We accept payment by the following methods - Direct deposit into the owners bank account, paypal or bank cheque.
(g) Personal cheques will be accepted if received at least 30 days prior to arrival.
(h) Bank details for payments will be provided after the approval of a guest booking.
5. CANCELLATION OR VARIATION OF BOOKING
(a) If you wish to vary or cancel your Booking, please contact us immediately.
(b) Your deposit is non-refundable in the event of a cancellation.
(c) A Booking variation which reduces the number of nights stay will be a treated as a Booking cancellation in respect of those nights.
(d) There is a minimum nights’ stay policy of 5 nights (except long weekends).
(e) No refund will be made for a variation to the extent that it breaches our minimum nights’ stay policy.
(f) An administration charge of $100.00 will be charged for any variation or cancellation.
(g) If the Property is able to be re-booked for the period cancelled a further refund may be made less admin charges and expenses.
6. SECURITY BOND
(a) A Bond payment of $1000 is required at the same time as the outstanding balance of your Booking.
(b) It will be credited to your designated account once the property has been inspected and deemed left in a similar state to arrival.
(c) We agree to ensure this occurs within 7 working days of your departure.
(d) Any damage, loss or expense incurred by the owners as a result of your breach of these Terms & Conditions will be taken out of the Bond and extra costs may be charged to you if damages or replacement exceeds the Bond amount. Examples of this include, but are not limited to, any breakage, damage or excess cleaning requirements or extra guests beyond those declared on the booking form.
7. UNAVAILABILITY
If the Property becomes unavailable for your occupancy due to unforeseen circumstances (eg. fire, storm, damage etc) then the owners will inform you immediately and endeavour to obtain suitable alternative accommodation for your occupancy; failing which any moneys paid by you will be refunded in full.
8. LINEN AND TOWELS
We supply all the linen, pillows, bath towels, beach towels, doonas, doona covers, blankets and tea towels which must be left where supplied in the bedrooms or bathrooms on departure. You will be charged for any damaged or missing items.
9. PETS
Pets are NOT allowed at or on the Property. There will be no exceptions.
10. PARTIES & FUNCTIONS
(a) This is a strictly ‘no party’ property - it is a family home.
(b) Any event or function requires prior approval at the time of Booking and special conditions will apply including extra charges.
(c) If a function is approved by the owners, guests remain responsible for persons attending, no disturbance of neighbours, no undue noise, quiet when entering and leaving the premises, no behaviour likely to cause damage to property or offence to others.
(d) Breach of this condition will result in immediate termination and eviction without refund and you will forfeit your bond, plus extra charges for security, cleaning, garbage removal, wear and tear, repairs etc will be charged to you.
(e) Illegal drugs and activities are strictly prohibited on this property.
11. YOUR OTHER RESPONSIBILITIES
(a) You must comply with all applicable House Rules and all instructions from the owners of the Property concerning occupancy, property, health, safety and the quiet enjoyment of the Property and our neighbours.
(b) You are responsible and liable for, damage, breakages, theft and loss of the Property and any part of it during your stay.
(c) You must notify us of this immediately. You will be responsible for the replacement cost.
(d) Only the guests nominated and agreed in the Booking may stay in the Property overnight. If any other guests stay beyond 11pm extra charges will apply or the agreement may be terminated without refund.
(e) Disturbance to our neighbours, including excessive noise, is prohibited and may result in termination and eviction without refund and loss of bond, and you will be liable for extra charges covering security and other expenses.
(f) Before departure, all food must be removed from fridges, all rubbish put in the appropriate council rubbish bins provided, and crockery and cutlery washed and packed away, including emptying the dishwasher.
(g) The Property must be left in a clean and tidy condition.
(h) Extra cleaning charges may be incurred for the cleaning of dirty dishes, putting away dishes, emptying the dishwasher, emptying the fridge, removal of excessive rubbish, excessive sand in the property etc. A minimum of $80 will be deducted from the bond.
(i) If the BBQ is not cleaned a minimum of $80 will be deducted from the bond.
(j) Should the cleaning fee be more than the usual cost for cleaning the property, you will be charged. The additional costs over and above the normal cleaning fee will be deducted from the security bond or charged as an extra cost.
(k) Please do not touch the electrical cabling and connections associated with the property's entertainment equipment. If a technician is required to be called to restore services after guest interference you will be charged for the call out fee and any required work (and a minimum of $80 will be deducted from the bond.
(l) If any of the above charges are over and above the bond, you will have 7 days to pay the amount owing before legal action is taken.
(m) All furniture and furnishings must be left in the position they were in when you arrived.
(n) The property should be vacated on time and secured. All windows and doors are to be locked.
(o) All keys must be returned as directed. You are responsible for the safekeeping and replacement of accommodation keys. Replacement cost will be $80.
(p) This is a non-smoking property. Smoking is not permitted in or on the Property.
(q) On entering this property, all guests and visitors will be responsible for their own health and safety. The owners of the property will not be liable for any accident, illness or injury that may occur during your stay.
12. PROBLEMS OR COMPLAINTS
(a) In the case of any problem or complaint, you must inform the owners at the earliest opportunity so they have the chance to rectify the situation as quickly and efficiently as possible.
(b) You must allow repair/service access to the property during reasonable hours.
(c) Any complaint, which cannot be resolved locally, must be notified in writing to the owners prior to departure from the Property.
(d) Failure to follow these procedures may hinder the ability of the owners to rectify the problem or complaint and reduce or extinguish any claim you may have.
(e) We recommend all guests purchase travel insurance since the owners are not responsible for any injuries, illness or accidents that may occur whilst staying at 7 Donlan Road, Mollymook Beach.
13. IMPORTANT NOTES
(a) The trampoline, stroller, bassinet, highchair, Kathmandu back pack, surfboards and boogie boards are to be used at your own risk.
(b) The house does have some special artworks and unique pieces, so please care for them as your own.
(c) The person signing the booking form will accept full responsibility for all breakages, damage and missing property caused by themselves, their children or their guests - this includes any outside visitors to the property - and will be fully liable for the replacement and repair costs and any additional charges.
(d) Please be aware that 7 Donlan Road has an excellent neighbourhood watch.
If you are not happy with any of the terms or arrangement specified in these T&Cs, please don’t book with us.
7 Donlan Road, Mollymook Beach is a much loved family home, not a commercial business.
